A title search on our Morningside house found an open permit. What now?
An open or expired permit follows the property, not the contractor who pulled it, and a title company will hold your closing until it clears. We start with the record: what was permitted, what was actually built, what is still missing. If the original contractor has disappeared, we can become the contractor of record and obtain permission to complete the work. Concealed work sometimes needs an engineer's letter. Then inspections, then the final. Plan on weeks rather than days, and start long before the closing date.
Who issues building permits for the Upper East Side?
The City of Miami Building Department. Unlike Miami Shores Village next door, the Upper East Side is not its own municipality — Morningside, Belle Meade, Bay Point, Bayside, Palm Grove, Shorecrest and Magnolia Park all file with the city, applications through iBuild and drawings through ePlan, under Miami 21 zoning. Behind the city sits Miami-Dade County, whose product control approvals govern anything installed in the High-Velocity Hurricane Zone and whose recertification program reaches buildings once they hit a certain age.
Does historic designation change the permit process in Morningside?
Only for what the street can see. Interior work is reviewed like any other permit. Exterior changes in Morningside, Bayside and Palm Grove — windows, doors, roofing, fences, additions, even paint on a contributing house — need a Certificate of Appropriateness before a building permit can issue. Modest, like-for-like changes are often handled at staff level; larger ones go to the Historic and Environmental Preservation Board. We prepare the application and carry it through, with that step built into the schedule instead of discovered halfway.
The previous owner closed in the garage without a permit. Can that be legalized?
Often, yes, and it is far better to do it before the house goes on the market. The path runs backwards: an architect or engineer documents what exists, we open finishes so an inspector can see the wiring, framing and plumbing now hidden behind them, and the space is brought up to current code — egress, smoke alarms, HVHZ openings. Then it is permitted and inspected as built. Occasionally zoning will not allow the use at all, and the honest answer is to restore the space.
Our building near Shorecrest received a recertification notice. Do you handle the repairs?
Yes. The inspection itself is an engineer's or architect's job, and we bring one in rather than claim it as ours. Our part is what the report demands: concrete and stucco restoration, waterproofing, balconies and railings, electrical corrections, plus the permits and inspections that close the file. Miami-Dade recertification reaches buildings by age and repeats on a cycle after that; the state milestone inspection applies to condominium and cooperative buildings three habitable stories and taller, with the structural integrity reserve study alongside it. We price the repair scope in writing.
